Farm Visit, Volunteer, Boarders, Riding Students Liability Release Form

SERIOUS INJURY MAY RESULT FROM YOUR VISIT TO THE FARM OR PARTICIPATION IN THIS ACTIVITY
PLEASE READ CAREFULLYTHIS AFFECTS YOUR LEGAL RIGHTS

In exchange for participation in the activity farm visit, volunteering, boarding, or riding horses, and contact with any/all farm or otherwise household animals, organized by Pine Lake Pastures-Personal Ponies, Ltd, from here on out known as PPLTD)- or Tom and Cheri Morton, of 1183 205th St. Baldwin, WI 54002 and/or use of the property, facilities and service of PPLTD-Pine Lake Pastures or Tom and Cheri Morton, I agree for myself and (if applicable) for the members of my family to the following:

1. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by TOM AND CHERI MORTON, PPLTD or the employees, representatives, volunteers or agents of PINE LAKE PASTURES, PPLTD- TOM AND CHERI MORTON.
2. I know, recognize and understand that animal behavior is inherently unpredictable and that there are certain inherent risks associated with the above described activity. I assume full responsibility for personal injury to myself and (if applicable) my family members, or group members and further release and discharge PINE LAKE PASTURES, TOM & CHERI MORTON- PPLTD for injury, loss or damage arising out of my or my family’s use of or presence upon the facilities of PINE LAKE PASTURES, TOM & CHERI MORTON, PPLTD, whether caused by the fault of myself, my family, PPLTD- TOM & CHERI MORTON, PINE LAKE PASTURES, OR OTHER THIRD PARTIES.
3. I agree to indemnify and defend PPLTD-TOM & CHERI MORTON, PINE LAKE PASTURES against all claims, causes of action, damages, judgments, cost or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family’s use of or presence upon the facilities of PPLTD-TOM & CHERI MORTON, PINE LAKE PASTURES. I agree to pay for all damages to the facilities of PPLTD-TOM & CHERI MORTON, PINE LAKE PASTURES caused by my or my family’s negligent, reckless or willful actions.
4. I consent to the participation of my child(ren)_____and/or myself_____, and/or the group of_____ in the activity of either or all the following mentioned activities: farm visit, boarding horses, riding horses, volunteering, coming in contact with animals that could be dangerous, and agree on behalf of the above minor to all the terms and conditions of this Agreement. By signing this LIABILITY RELEASE FORM, I represent that I have legal authority over and custody of said child/children.
5. In the event of injury to the above minor during the above described activities, I give my permission to PPLTD-TOM & CHERI MORTON, PINE LAKE PASTURES, or to the employees, volunteers, representatives or agents of PPLTD-TOM & CHERI MORTON, PINE LAKE PATURES, to arrange for all necessary medical treatment for which I shall be financially responsible.
6. Futhermore, I understand that from time to time, photographs/videos may be taken at the PPLTD-TOM & CHERI MORTON, PINE LAKE PASTURES farm and that I may be in one of the photographs/videos. I do hereby give permission to PPLTD-TOM & CHERI MORTON, PINE LAKE PASTURES, to publish and use such photographs/videos for any lawful purpose.
7. Any legal or equitable claim that may arise from participation in the above shall be resolved under Wisconsin State Law.
8. All, references to PPLTD-TOM & CHERI MORTON, PINE LAKE PASTURES includes its Board of Directors, executive director and officers, agents, employees, independent contractors, instructors, physicians, therapists, and any associated professional and volunteers.

Wisconsin State Warning

Under Wisconsin State Law, an equine professional is not liable for an injury to, or death of, participant in equine activities resulting from the inherent risks of equine activities, pursuant to section 895.525 PROVISIONS COMMON TO ACTIONS AND PROCEEDINGS IN ALL COURTS MISCELLANEOUS GENERAL PROVISIONS.
